An Appeal Division of the Kano State High Court has commenced hearing an appeal filed by Sheikh Abduljabbar Nasiru Kabara, challenging the death sentence verdict slammed on him by Justice Ibrahim Sarki Yola of the Upper Shari’ah Court.
On December 15, 2022, SaharaReporters reported how an Upper Sharia Court sitting in Kano has sentenced controversial Islamic cleric Abduljabbar Nasiru Kabara, to death by hanging.
The embattled Nigerian cleric was arrested and detained by the state government for allegedly making blasphemous statements against Prophet Muhammad.
According to the charge, his statements are capable of disrupting public peace.
Abduljabbar was charged on July 16, 2021, by the Kano State government before Justice Sarki Yola over alleged blasphemy and incitement.
When the case came up on Monday for mention, the counsel for the appellant, Barrister Sadik Yusuf, announced the readiness of his client to proceed with the hearing, but the counsel for the Kano State government, Barrister Bashir Saleh, requested an adjournment for a later date.
Frustrated by the request, the appellant's counsel swiftly prayed the court to award a N20million cost against the respondents for wasting the appellant’s time.
However, the counsel for the respondents objected to the request, stating that they were served with the court processes in March, and not February, as claimed by the appellant’s counsel.
After hearing arguments on both sides, the court rejected the cost application and adjourned the case to May 9, 2024, for hearing.
